Terms and conditions of sale
01 – PREAMBLE
This website www.BeBeret.com (hereinafter the “Site”) is operated by BeBeret, registered under number 313750382 in Israel. Its head office is in Raanana, Israel.
BeBeret can be contacted by e-mail at david.BeBeret@gmail.com.com. Papers must be submitted in writing in either French, Hebrew or English. These general terms and conditions (hereinafter referred to as the “general terms and conditions”) apply to orders placed on the site by any non-commercial individual (hereinafter referred to as the “user”) wishing to make a purchase on the site. The User and BeBeret are hereinafter collectively referred to as the “Parties”.
The parties agree that these terms and conditions shall exclusively govern their relationship. BeBeret reserves the right to modify these terms and conditions at any time. The parties are only bound by the terms and conditions that are online on the day of the order.
02 – PURPOSE
The purpose of the General Terms and Conditions is to define the conditions of sale between BeBeret and the User, from the placement of the order through payment and delivery to after-sales service. The terms and conditions are available in English and French, depending on the user’s choice.
03 – PRODUCTS
The general terms and conditions of sale apply to the products displayed and designated as being sold and shipped by BeBeret (hereinafter the “Products”).
Products are described and displayed as accurately as possible. However, BeBeret cannot be held responsible for any errors or omissions.
Product photographs are non-contractual.
04 – PRICES
Product prices are displayed in euros (€), US dollars (US $), pounds sterling (GPD) and new Israeli shekels (NIS), value added tax at the rate in force on the day the contract is concluded. . They also include any price reductions applicable on the day the order is placed.
This price does not include delivery charges (shipping and packaging costs according to the appropriate tariff). These delivery costs must be indicated on the order form before the order is confirmed.
The order is subject to customs duties and/or taxes (including any local taxes) which must be paid by the user. In this case, BeBeret will only invoice the User for the price of the order, excluding VAT. Please note that BeBeret is unable to determine the amount of these taxes in advance. In this respect, users are advised to contact their national customs office to check the latest local requirements in force in their country.
The prices of the products quoted on the site are valid as long as they are online.
05 – PLACING AN ORDER
5.1 Preliminary user identification.
To place an order, the user must log in with his e-mail address or customer number and password. If this is the User’s first order, he/she will follow a registration procedure as indicated on the Site.
If you lose or forget your password, you can request it again by logging into your customer account and clicking on “I’ve forgotten my password”. It will be sent to the e-mail address provided at the time of registration.
The user may also contact customer service under the conditions defined in the preamble.
5.2 Order registration and confirmation
The user must place his order exclusively online, via the site.
Once the order has been confirmed, the user accepts the terms and conditions of sale, selects the delivery address and confirms payment. This final step is the conclusion of the sales contract between BeBeret and the user.
By placing an order, the user accepts the prices and descriptions of the products offered for sale. Any complaint in this respect will be made by exercising the right of withdrawal and the legal and contractual guarantees mentioned below.
BeBeret reserves the right to freeze the User’s order in the event of non-payment, incorrect (delivery) address or any other problem occurring on the User’s account until the problem is resolved.
If the product ordered and paid for is not available in stock (temporary unavailability or out of stock), the user will receive an e-mail informing him of this unavailability. If the product is sold out, it will be cancelled and removed from the order and the user will receive a full refund. However, the rest of the order remains firm and final.
If you have any questions about tracking an order, please consult your customer account on the site or contact customer service. Once you have received the e-mail confirming shipment of your order, you can track it.
5.3 Confirmation of order by BeBeret.
BeBeret will acknowledge receipt of the User’s order by sending an e-mail to the e-mail address previously provided by the User.
06 – PAYMENTS
BeBeret guarantees the confidentiality and security of any payments made by the user. In this case, all data transmitted to the bellisssini.com website uses the “https” protocol and the “SSL” (Secure Socket Layer) encryption system. As such, you can find a padlock in the address bar of our site attesting to the presence of these security features on the bellissini.com site. The user must pay exclusively online:
– By credit card via Paypal: credit cards, electronic cards, Visa, Mastercard. The user’s bank account will be deducted once the shipment has been dispatched. Only the price of products actually shipped will be deducted. To pay with your card via PayPal, you don’t need to sign up for a PayPal account.
– With your PayPal account: By choosing to pay with your PayPal account, you will be automatically redirected to your PayPal account. Once the PayPal payment has been confirmed, the User may terminate the order on the Site. The user’s PayPal account will be deducted immediately after final confirmation of the order.
07 – DELIVERY
The parcel must be delivered to the delivery address indicated by the user.
Shipping is carried out by BeBeret, but BeBeret is not responsible for the package once it has been delivered to the post office. From that moment on, the buyer is entirely responsible for the correct delivery of the parcel and its contents.
The parcel will be shipped to customers in the 26 countries below (except Israel) by Eco-post ONLY and limited for parcels up to 2 kg. The user will receive a tracking number. Eco-Post parcels should normally be collected by the user from the post office in the country of destination.
Eco-Post shipment normally takes between 6 and 7 working days, with the exception of Australia, between 11 and 12 days. BeBeret shall not be liable for any delay in delivery. The shipping process is the sole responsibility of the buyer.
The Eco-Post is currently available from Israel in 26 countries:
Europe: Austria, Belgium, Denmark, England, Finland, France, Germany, Greece, Ireland, Italy, Netherlands, Norway, Poland, Portugal, Russia, Spain, Sweden and Switzerland.
Americas: United States of America, Canada and Brazil
Asia: Hong Kong, Japan, Taiwan and Thailand.
Oceania: Australia
For the other countries below where BeBeret ships and which are not part of the Eco-post program from Israel, parcels will be shipped by International Air Mail or EMS.
The countries or destinations included in this program are: Argentina, Bosnia Herzegovina, Bulgaria, Chile, China, Cyprus, Czech Republic, Estonia, Georgia, Gibraltar, Guadeloupe, Hungary, Iceland, India, Latvia, Lithuania, Luxembourg, Martinique, Monaco, New Zealand, Panama, Singapore, Slovakia, Slovenia, South Africa, Tunisia, Turkey and Uruguay.
Shipment by International Air Mail normally takes between 14 and 30 working days, and is limited for parcels up to 2 kg. BeBeret shall not be liable for any delay in delivery. The shipping process is the sole responsibility of the user.
EMS shipping is paid in full by the purchaser, regardless of the amount ordered. Delivery normally takes between 3 and 5 working days and is limited for parcels up to 2 kg. BeBeret shall not be liable for any delay in delivery. The shipping process is the sole responsibility of the user. The user will receive a tracking number. For deliveries in Israel only: the buyer has the possibility to collect the good(s) from our office in Raanana, three (3) days after order confirmation. The full address will be supplied to the customer on request. Pick-ups must be coordinated with BeBeret by e-mail at david.BeBeret@gmail.com.
Shipments to Israel are made in regular shipments of small cartons. Delivery is normally made within 7 working days. The parcel is collected from the post office (Do’ar Israel) after receipt of the letter carrier’s notice at the destination. BeBeret shall not be liable for any delay in delivery. The shipping process is the sole responsibility of the user.
In addition, for shipments
in Israel, it is possible to ship by Do’ar Mahir. The cost of shipping is borne in full by the purchaser, regardless of the amount ordered. Delivery normally takes between 3 and 4 working days and is limited for parcels up to 2 kg. BeBeret shall not be liable for any delay in delivery. The shipping process is the sole responsibility of the user. The user will receive a tracking number. Packages in Doar Mahir are delivered to the user’s home.
08 – RIGHT OF WITHDRAWAL AND REFUND
The user may cancel the contract within fourteen (14) days of receipt of the package.
The Customer must return the Product to BeBeret only and solely to the following address: Ya’ara, 4 – Raanana 4320441 – ISRAEL by the carrier of his/her choice, it being specified that the return shipping costs are to be borne entirely by the Customer and this within 14 (fourteen) working days, as evidenced by the postmark or carrier’s stamp.
BeBeret undertakes to reimburse the User as soon as possible, and no later than thirty (30) days from the date on which BeBeret receives the returned order.
Shipping costs will not be refunded to the customer.
Similarly, for foreign customers who have taken advantage of free delivery and returned part or all of their order, the sum of €20 will be deducted from their refund to cover packaging and delivery costs.
For Israeli customers who have taken advantage of free delivery and returned part or all of their order, the sum of between €5 and €7 (or the equivalent in the local currency of purchase) will be deducted from their refund to cover packaging and delivery costs.
Thus, if the User has paid by credit card, BeBeret will credit the amount to his/her (bank) account. If the user has used his PayPal account to make the payment, his PayPal account will be credited.
09 – GUARANTEES
All products sold by BeBeret are subject to strict quality controls. However, despite our great care, some items may be defective. In this case, the User is requested to return the said items within fourteen (14) days of receipt of the parcel, specifying the type of defect on the returns form attached to the invoice. In addition, the user benefits from the legal protection of the Consumer Law in force in Israel.
10 – LIABILITY
BeBeret undertakes to describe and display all products sold on the Site as accurately as possible. However, BeBeret cannot be held liable if the non-performance of its obligations is due to an unforeseeable and insurmountable event caused by a third party to the contract or a case of force majeure. Likewise, BeBeret cannot be held responsible for any inconvenience or damage caused by the use of the Internet network, i.e. interruption of service, external intrusion or the presence of computer viruses. BeBeret cannot be held responsible for non-compliance with a provision in force in the user’s country, in relation to which the user has not actively targeted its activities via marketing operations.
11 – INTELLECTUAL PROPERTY
All content you see and hear on the site, including the underlying technology, is protected by copyright, trademark or patent. The trademarks, logos and models displayed on the site belong exclusively to BeBeret. Their disclosure does not constitute a license granted by BeBeret or a right to use any of said trademarks and distinctive features protected by copyright. As a result, they cannot be used without being counterfeited. Thus, it is strictly forbidden to copy, reproduce, download, post, transfer or distribute any document from the Site in any way whatsoever.
However, this will be permitted in the following cases: it is possible to download a copy of these documents onto a computer for strictly personal, non-commercial use, provided that the user does not modify the information and does not keep the copyright and other proprietary notices intact. Modification or misuse of these documents constitutes a violation of BeBeret’s intellectual property rights.
When a user who owns his own website (for non-commercial use) wishes to include a link to the site’s home page, he must request BeBeret’s authorization before doing so. This does not mean implied, nor does it mean a transfer or assignment of right, title or interest in any content or material.
However, any hypertext link to the Site using “framing” or “inline linking” techniques is strictly prohibited. In all cases, any link may be removed at the request of BeBeret.
12 – PERSONAL DATA
In order to effectively fulfill its obligations, BeBeret must collect certain personal information about the User (last name, first name, e-mail address and home address). By providing BeBeret with their email address, Users may receive an email acknowledging receipt of their orders. BeBeret makes every effort to ensure the confidentiality and security of data transmitted over the Web. In this respect, please note that the BeBeret website uses a secure payment method, called Secure Socket Layer (SSL).
13 – LAW AND JURISDICTION
These terms and conditions shall be governed by and construed in accordance with Israeli law. Contracts entered into via the Site, as well as any disputes arising therefrom, are governed by Israeli law. An amicable solution (via an ombudsman system) should be considered before any legal recourse. If this solution fails, the Israeli court in Kfar-Saba will have sole jurisdiction over these disputes.
